Withdrawal from Contract
If you are a so-called privileged buyer, meaning:
A) a consumer
or
B) a natural person for whom the contract concluded with us is directly related to your business activity but is not of a professional nature for you
– you are, as a rule, entitled to the right to withdraw from a distance contract.
You may withdraw from the contract by submitting a withdrawal statement to us, e.g. by e-mail to: shop@blulou.pl.
You may withdraw from the contract within 14 days.
The 14-day withdrawal period begins from the moment you or a third party designated by you (other than the carrier) takes possession of the goods, or, in the case of a contract covering multiple items delivered separately, in batches or in parts, from the moment you take possession of the last item, batch or part.
It is sufficient to send the withdrawal statement before the deadline expires.
Please return the goods to us without undue delay to: ul. Leśna 1a, 44-102 Gliwice, and in any event no later than 14 days from the date on which you withdrew from the contract.
We will refund your payments without undue delay in accordance with the Store Terms and Conditions, and in any event no later than 14 days from the date we receive your withdrawal statement.
If we have not offered to collect the goods from you, we may withhold the refund until we have received the goods back or until you have provided proof of their return, whichever occurs first.
Please note that the right of withdrawal from a distance contract does not apply, among others, to contracts:
- where the subject matter is a non-prefabricated item manufactured to your specifications or clearly personalised;
- where the subject matter is an item that deteriorates rapidly or has a short shelf life;
- where the subject matter is an item supplied in sealed packaging which cannot be returned after opening for health protection or hygiene reasons, where the packaging has been opened after delivery;
- where the subject matter is audio or visual recordings or computer programs supplied in sealed packaging, where the packaging has been opened after delivery.
Full details on the right of withdrawal can be found in our Store Terms and Conditions.
Complaints
The following applies to so-called privileged buyers. If you do not qualify as one, please refer to our Store Terms and Conditions for detailed information on complaints.
If we fail to perform the contract concluded with you properly, you have the right to submit a complaint – preferably by e-mail to: shop@blulou.pl or by post to: ul. Marcina 11, 40-854 Katowice.
As a rule, we are liable for any lack of conformity of the goods with the contract that existed at the time of delivery and became apparent within two years of that time.
Under the provisions of the Consumer Rights Act, in such a situation you may demand:
a) replacement of the goods
or
b) repair of the goods.
In certain cases you may also:
a) withdraw from the contract
or
b) submit a statement of price reduction
– full details can be found in our Store Terms and Conditions.
